Logo v. Wordmark

[vc_row][vc_column][vc_column_text]We get this question a lot, should I get my logo or just the words of my trademark?

Since I haven’t met you yet, I can’t answer that question for your unique situation, but what I can do is explain one of the differences between the protections offered through a logo verses the words.

If you get a registered trademark for the words that compose your trademark, your logo is protected so long as your logo contains those words. So let’s do an example. Let’s say your company is called ABC Rugs.  If your logo has a cat, wearing some sunglasses, under an umbrella on the beach all under the words “ABC Rugs,” that use of the trademark is protected because those words belong to you, so to speak. If you take the cat out, and you put in a unicorn, that use is also protected so long as it says ABC Rugs.

Where registering a logo is different from registering the words, though, is that a logo is really protected exactly as its filed. So in the example I just gave you, if you filed the version with the cat, and then wanted to change it to a unicorn, you have to file a new trademark, because it was registered with the cat, not the unicorn. Any significant changes to the logo means you have to file a new trademark.

Every situation, business and trademark has its own nuances, so speak with an attorney about your trademark plan. [/vc_column_text][/vc_column][/vc_row][vc_row css=”.vc_custom_1650630912124{padding-top: 40px !important;}”][vc_column width=”1/5″][vc_separator color=”custom” accent_color=”#cdba6d”][/vc_column][vc_column width=”4/5″][/vc_column][/vc_row][vc_row css=”.vc_custom_1650631542230{margin-bottom: 50px !important;}”][vc_column][themestek-custom-heading text=”ABOUT THE AUTHOR” font_container=”tag:h2|font_size:13px|text_align:left|color:%23d90a2c|line_height:26px” use_theme_fonts=”no” google_fonts=”font_family:Montserrat%3A100%2C100i%2C200%2C200i%2C300%2C300i%2C400%2C400i%2C500%2C500i%2C600%2C600i%2C700%2C700i%2C800%2C800i%2C900%2C900i|font_style:600%20Semi-bold%3A600%3Anormal” el_class=”subheading-letter-spacing”][/vc_column][/vc_row][vc_row][vc_column width=”1/6″][vc_single_image image=”12657″ img_size=”100×100″ style=”vc_box_circle_2″ onclick=”custom_link” link=”/team/chris-brown/”][/vc_column][vc_column width=”5/6″][themestek-custom-heading text=”Chris Brown” font_container=”tag:h6|font_size:22px|text_align:left|color:%23323a43″ link=”url:%2Fteam%2Fchris-brown” el_class=”themestek-box-team-position themestek-skincolor themestek-pf-box-title”][themestek-custom-heading text=”Managing Attorney” font_container=”tag:div|text_align:left” el_class=”our-team-staff-subheading”][vc_column_text css=”.vc_custom_1650631634025{padding-top: 20px !important;}”]Chris is the managing attorney for the Business Law Division of the firm.
